Pavilion Cinema Gift Card Terms & Conditions.

These terms and conditions govern the purchase and use of a Pavilion Cinema Gift Card. Please read the terms in full before you purchase a gift card.  If you do not accept these terms, please do not purchase a gift card. Purchasing and using a gift card implies that you accept these terms. We do occasionally update these terms so please refer back to them in the future. The last update to these terms & conditions was made on 29th October 2018

1. Definitions

Gift Card: a pre-paid plastic card issued by the Pavilion Cinema which can be used to make purchases during the relevant validity period (see condition 3.4 below) at the Pavilion Cinema and on our Web Site at www.pavilioncinema.co.uk;

Transaction Value: the value of any cinema tickets, merchandise, or food and beverages purchased with the Gift Card;

we/us/our/Pavilion Cinema: Pavilion Cinema, Galashiels;

User: anyone who has access to the Gift Card (and pin where applicable);

you/your/yours: the person to whom the Gift Card is issued.

2. General

2.1 These Conditions apply to the purchase and use of all Gift Cards and by purchasing the Gift Card you agree to be legally bound by the Conditions. By using the Gift Card the User will be deemed to have accepted these Conditions. We have the right to amend or vary these Conditions from time to time at our sole discretion but changes will not apply retrospectively.

3. Use of Pavilion Cinema Gift Cards

3.1 The Gift Card is valid for use in Pavilion Cinema, Galashiels or on the Pavilion’s Web Site at www.pavilioncinema.co.uk. The value on the Gift Card can be used towards payment for the purchase of cinema tickets, food and beverages or merchandise and towards payment for the purchase of cinema tickets online.  Gift Cards may not be used to purchase other Gift Cards.

3.2 You may give the Gift Card to anyone else to use but the Gift Card may not be re-sold. Please make sure that you and/or the recipient keep the Gift Card safe as anyone who presents the Gift Card or has access to the Gift Card number and PIN will be able to redeem it.

3.3 Where the value on the Gift Card is less than the total Transaction Value, the User will be required to make up the difference in price (if redemption is on our web site such payment will need to be by credit, debit, or charge card but may not be made using other Gift Cards).

3.4 Gift Card validity period: The Gift Card shall be valid for 18 months from the date of purchase or, if later, the date of the last top-up made. Once the entire balance has been used and no top up has been made, the gift card will be deactivated and will not be re-usable. Any balance unused in this 18 month period will be cancelled and no refund will be given.

3.5 When the Gift Card is used the amount of the Transaction Value will be deducted from the balance on the Gift Card.

3.6 The remaining Gift Card balance may be checked in our cinemas at any till point or by calling the Cinema on 01896 752767.

3.7 Gift card balances can not be exchanged for cash.

3.8  Defaced, illegible, or photocopied Gift Cards will not be accepted.

3.9 Gift Card holders are not entitled to preferential treatment over other customers for the purchase of cinema tickets, merchandise or food and beverages.

4. Lost, stolen or defective cards

4.1 Please take care of your Gift Card because if it becomes lost or stolen or the barcode, serial number or PIN have become unreadable it can not be replaced.

4.2 If your Gift Card becomes defective or you are having trouble using your Card online, please return the Card to the Cinema for assistance.

5. Liability

5.1 Except as expressly provided in the Conditions, all warranties, conditions or other terms in favour of you or the User implied by Statute or common law are excluded to the fullest extent permitted by law.

5.2 Nothing in the Conditions is intended nor shall it be construed to limit our liability for fraud or death or for personal injury caused by our negligence.

5.3 The Pavilion Cinema shall in no circumstances be liable if the Cinema closes permanently or temporarily or if our website is unavailable, for whatever reason or if a particular film or item of merchandise, food or beverage is not available for whatever reason.

5.4 We shall not be liable to you or the User by reason of any failure or delay in performing any of our obligations in relation to the Gift Card under the Conditions if the failure or delay was due to any cause beyond our reasonable control.

5.5 We shall not be liable to you or the User in respect of any indirect or consequential loss, damage, costs or expenses or other claims for consequential compensation whatsoever which arise out of or in connection with the Gift Card.

5.6 Our liability to you or the User shall not exceed the amount paid by you for the Gift Card.

5.7 We shall not be liable to you or the User in the event of loss, theft, unauthorised use or re-sale of any Gift Card.

6. Privacy.

6.1 Any data provided at the time of purchase of the Gift Card or collected as part of your ongoing use of the Gift card is subject to our general Privacy Policy which can be found here: Pavilion Cinema Privacy Policy

7. Future changes to gift card terms and conditions.

7.1 These terms and conditions are kept under constant review and Pavilion Cinema reserves the right to make changes to these terms and conditions at any time.
